Employers Must Submit BWC Settlement Claims by October 22, 2014

Group-rated employers who received a settlement claim form from the San Allen Inc. v. Bureau of Worker's Compensation settlement have until October 22, 2014 to mail in their completed claim form. 

After an $859 million dollar judgment was handed down in the Cuyahoga County Court of Common Pleas on March 20, 2013, the Bureau of Worker's Compensation agreed to establish a $420 million Settlement Fund for the benefit of the members of the class.

The class consists of private non-group rated employers who, in one or more policy years from 2001-2008: (1) subscribed to the state workers’ compensation fund; (2) were not group-rated; and (3) reported payroll and paid premiums in a manual classification for which the non-group effective base rate was ‘inflated’ due to application of the group experience rating plan, are members of the Class.

Class members are required to complete a claim form postmarked by October 22, 2014 in order to receive their pro rata share of  the Settlement Fund.

Employers who did not receive a notice by mail, but meet the eligibility requirements above, should contact the Settlement Administrator toll-free at (844) 322-8230 and provide the employer’s Ohio BWC policy number and Employer Identification Number (EIN). Claim forms can be sent to employers via email.
